§ 4-84. Volume ratio exemptions.

  • (a)

    Business establishments that have a valid consumption on premises license for malt beverages, wine or distilled spirits and meet the following requirements are exempt from the food sales ratios as provided in section 4-82 and retail sales ratios as provided in section 4-83 above:

    (1)

    There shall be no fee, donation or cover charge collected or required to obtain entrance into the business or a requirement to purchase any food or beverages.

    (2)

    The business shall have a maximum occupancy load of 75 individuals with seating arranged and set for at least 50 percent of the maximum occupancy load. Folding chairs, lawn furniture or other furniture that, in the opinion of the City of Dallas, Georgia marshal, is not "set" is not in compliance with this subsection and shall not be allowed.

    (3)

    No alcoholic beverages shall be served on Sunday.

    (4)

    Sales of alcoholic beverages are subject to the provisions of section 4-81, except that the business may not open prior to 4:00 p.m. Monday through Friday or 11:00 a.m. on Saturday.

    (5)

    Entertainment shall be allowed provided that no sound shall be audible beyond the licensed premises.
